By accessing the Site, creating an account, purchasing a license, downloading software, installing our WordPress plugins, or using our support channels, you agree to these Terms. If you do not agree, do not use the Site or our software.
Our WordPress plugins
MailPai offers email tools for WordPress as separate plugins that work together as one product family:
Installing MailPai Pro requires MailPai (Free). SMTPPai can be used on its own or alongside MailPai. References to “the Plugins” mean any of the above that you install or use.
1. What you are buying or downloading
Free plugins (SMTPPai, MailPai Free)
Available from WordPress.org and/or the Site. Use is governed by the GNU General Public License v2 (or later) for the GPL-covered code. You may use, modify, and redistribute GPL code only under the terms of the GPL.
MailPai Pro (paid)
A commercial license sold through the Site. Depending on your purchase, you may receive:
- A license key and/or downloadable package
- Updates and support for the period stated at checkout
- Documentation as described on the Site
Pro software, license keys, update entitlements, and non-GPL components are not GPL unless we explicitly say so. GPL applies only to the free plugin code distributed under the GPL.
2. Eligibility and accounts
You must be able to form a binding contract in your jurisdiction. If you purchase on behalf of a company, you represent that you have authority to bind that company.
You are responsible for:
- Keeping account credentials secure
- Providing accurate billing and contact information
- All activity under your account
We may suspend or terminate accounts involved in fraud, abuse, or violations of these Terms.
3. Orders, pricing, taxes, and payment (MailPai Pro)
Prices are shown on the Site unless otherwise stated. We may change prices; changes apply to future purchases only.
You are responsible for applicable taxes unless we are legally required to collect and remit them.
Payment processing is handled by our payment partner(s). You agree to their terms and authorize charges for your purchase.
If a payment fails, is disputed, or is reversed, we may revoke license entitlements and access to paid services until the matter is resolved.
4. License grant (MailPai Pro)
Subject to payment and compliance with these Terms, MailPai grants you a limited, non-exclusive, non-transferable license to use MailPai Pro according to the plan you purchased, including:
- Activation limits (number of sites) as stated at purchase
- Use on your own sites unless an agency or multi-site plan explicitly allows client use
- No redistribution of paid packages, license keys, or access credentials
- No resale of licenses except under a written reseller agreement
Updates and support apply only during the active subscription or license term unless stated otherwise at checkout.
5. Updates, compatibility, and service availability
We may release updates to improve security, compatibility, features, or compliance.
You acknowledge that:
- WordPress, PHP, hosting, and email providers (e.g. Amazon SES, Google, Microsoft) change frequently
- We do not guarantee uninterrupted operation, deliverability, inbox placement, or compatibility with every host or third-party plugin
- You are responsible for testing on staging when appropriate and maintaining backups
Unless a separate written SLA exists, the Site, downloads, updates, and support are provided “as is” and “as available.”
6. Acceptable use
You agree not to:
- Use our Plugins or the Site to violate applicable law (including spam, phishing, harassment, or deceptive practices)
- Send email without valid consent where required by law
- Violate your email provider’s policies (Amazon SES, Google, Microsoft, Mailgun, etc.)
- Attempt to hack, overload, scrape, or bypass technical limits, licensing, or security
- Use our OAuth relay or connections in ways not intended by the documented setup
We may refuse service for high-risk or abusive use.
Your responsibility: You are solely responsible for email content, subscriber lists, consent, unsubscribe compliance, and provider account compliance.
7. Third-party and external services
Our Plugins connect to services you choose to configure, including:
- Email delivery providers (Amazon SES, Mailgun, Postmark, Resend, Brevo, Mailjet, and others) — message content and recipients are sent to your chosen provider for delivery
- Google and Microsoft — OAuth sign-in when you connect Gmail or Microsoft 365
- auth.mailpai.com — optional HTTPS redirect relay during OAuth; forwards an authorization code only; does not store your OAuth tokens on our servers
Your use of third-party services is governed by their terms and privacy policies. We are not responsible for third-party outages, pricing, policy enforcement, or deliverability.
Free plugins distributed on WordPress.org are also subject to the WordPress.org Plugin Directory guidelines where applicable.
8. Support
Support for MailPai Pro (if included in your plan) covers good-faith help with installation and documented features. Support typically does not include custom development, full server administration, guaranteed deliverability, or debugging every third-party conflict.
SMTPPai and MailPai Free on WordPress.org are supported through the WordPress.org support forums unless we offer separate paid support on the Site.
Support channels and response times are described on the Site or in your plan.
9. Intellectual property
The MailPai name, branding, marketing content, documentation, videos, and non-GPL assets belong to MailPai or our licensors. Except for rights expressly granted (including GPL for GPL-covered code), you may not copy, modify, distribute, or create derivative works without permission.
SMTPPai, MailPai, and MailPai Pro are product names of MailPai. Third-party names (Amazon SES, Google, Microsoft, WooCommerce, WordPress, etc.) are trademarks of their respective owners; MailPai is not affiliated with them unless stated otherwise.
10. Refunds and chargebacks
MailPai Pro is digital software delivered immediately after purchase.
Unless required by law or stated otherwise at checkout: all sales are final once the license key or download has been delivered.
If we publish a refund window on the pricing or checkout page, that policy applies for that purchase.
Initiating a chargeback may result in immediate license revocation. Reinstatement after a resolved dispute is at our discretion.
11. Disclaimer of warranties
To the maximum extent permitted by law, MailPai disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Email delivery depends on third-party networks and your configuration. Nothing on the Site guarantees revenue, list growth, or inbox placement.
12. Limitation of liability
To the maximum extent permitted by law, MailPai and its officers, directors, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Plugins or the Site.
Our total liability for any claim relating to these Terms or the Plugins is limited to the amount you paid to MailPai for MailPai Pro in the twelve (12) months before the claim, or USD $100 if you only use free plugins, whichever is greater, except where law does not allow such limits.
13. Indemnity
You will defend and indemnify MailPai against claims arising from:
- Your use of the Plugins or the Site
- Your email content, lists, consent practices, and compliance obligations
- Your violation of these Terms or third-party rights
14. Termination
We may suspend or terminate access to the Site, license portal, updates, or support if you materially breach these Terms or create legal or security risk.
You may stop using the Plugins at any time. Termination does not remove obligations that accrued before termination (payment, indemnity, etc.).
Uninstalling a plugin does not automatically cancel a MailPai Pro subscription; manage billing through your account or checkout provider.
15. Privacy
Personal information is handled as described in our Privacy Policy. Purchases and support may create additional records described there.
SMTPPai and MailPai store email logs and credentials on your WordPress server unless you configure otherwise; we do not receive your subscriber lists or email content for marketing analytics through normal plugin operation.
16. Changes to these Terms
We may update these Terms by posting a revised version and updating the “Last updated” date. Material changes may be announced on the Site or by email where appropriate. Continued use after the effective date means you accept the updated Terms, except where prohibited by law.
17. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except where consumer protection laws in your country require otherwise.
18. Miscellaneous
- Entire agreement: These Terms and checkout or license documents are the full agreement for Site and MailPai Pro sales.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Severability: If one provision is invalid, the rest remains enforceable.
- No waiver: Failure to enforce a provision is not a waiver.
- Language: The English version controls if translations conflict.
